Thaksin filing lawsuit for Bt1.5 billion damages

BANGKOK, Aug 23 (TNA) – Former prime minister Thaksin Shinawatra and his spouse, Khunying Pojaman, have assigned a lawyer to file a Bt1.5 billion (US$44 million) damages lawsuit against Department of Special Investigation (DSI) chief Sunai Manomai-udom regarding the SC Asset Corp stock concealment charges.


Pichit Chuenbarn, lawyer for Mr. Thaksin and his wife, said the lawsuit seeking the Bt1.5 billion damage compensation was lodged Thursday with the Civil Court in response to the DSI chief's earlier accusations against the deposed prime minister and his spouse, and even claimed to have obtained evidence to find the couple guilty as earlier charged over the stock concealment scandal.

The DSI chief had alleged Mr. Thaksin had violated the Stock Exchange Act of 1992 by having a few nominees hold portions of SC Asset stocks on his behalf.

The Civil Court has scheduled initial hearing of the case for December 17.

Meanwhile, the DSI chief said such a legal battle would not affect his work and commented he might launch a counterstrike lawsuit in court against the deposed prime minister.

Mr. Sunai said he had merely done his duty and would be protected by law from any defamation cases.

Mr. Thaksin and Khunying Pojaman have also assigned another lawyer to file suit with the Criminal Court against Assets Examination Committee (AEC) chief Nam Yimyaem and 10 other committee members on misconduct charges involving the Ratchadaphisek land deal.

Mr. Pichit said the AEC chief and others had deliberately persecuted the former prime minister and his spouse as well as violated the Criminal Code and the National Counter-Corruption Act of 1999 by adopting undue procedures to prematurely hold them guilty of misconduct charges.

The AEC chief and others had allegedly mistreated the Ratchadaphisek land controversy by having the Office of Attorney General obtain arrest warrants for the accused couple from the Supreme Court in charge of criminal lawsuits against persons with political status, he said.

The Criminal Court has scheduled the first hearing in the case for November 26.
